now. today, monday, june 24th, 2024. high stakes, back-to-back hearings are happening today in former president donald trump's classified documents case. the two pay jar issues at play and why the judge overseeing it all is facing scrutiny. horror in arkansas, a suspected gunman opens fire killing four people in a small-town grocery store. travel guide, do you have a summer vacation you still need to plan? well, artificial intelligence pay be able to help. we'll show you how. it's paws-itively fetching! the winner of this year's world's ugliest dog competition. we'll start this hour with an important hearing in the federal classified documents case against former president donald trump. prosecutors are asking for a gag order against the former president, it's the second

hearing today and this morning, trump's lawyers argued to dismiss the indictment claiming that funding for special counsel jack smith is unconstitutional. judge cannon is overseeing both of the hearings. joining me now is ken dilanian outside the courthouse in florida. also with us nbc news legal analyst danny cevallos. ken, what are prosecutors asking for here? >> reporter: the special counsel is asking judge cannon to modify the conditions of donald trump's release, remember he's out on bond in this case, to order him to stop mischaracterizing a document that reminded the fbi of their use of force policy that was inclued in the paperwork that accompanied the mar-a-lago raid, donald trump has essentially lied about that document, his lawyers have as well, and supporters of his have said that was an authorization by president biden directing the fbi or authorizing the fbi to

use deadly force against donald trump during that search, that's false. it was a policy statement reminding the fbi they have a right to deadly force if they have a reasonable fear their life in danger. donald trump on social media and elsewhere has characterized this as an fbi assassination plot against him, his supporters have picked up that. jack smith said that's putting the lives of the fbi agents in danger. they talked about things that have happened particularly for example after the mar-a-lago search where a man armed with an ar-15 attacked in cincinnati. another trump supporter called the cell phone and threatened an fbi agent in the hunter biden. there's real-world consequences in this. >> ken, let's back up for a moment, the second of three days of hearings this trial was scheduled to start last month,

so what exactly is going on with the delays here? >> reporter: right, so, unlike the hearing on the gag order which is a reason to have a hearing, many of the hearings in this case are on e sot rick highly technical areas, that will be ended decided. the special counsel appointment was unconstitutional. today whether the appropriation, the funding is constitutional. questions hinge on legal proceedings. many judges wouldn't have had a hearing on these kind of issues. this case is getting delayed and delayed. unlikely to go to trial before november. >> danny, given all the delays, given the back-to-back, back and forth, the legal experts believe that yak smith should ask a

circuit court to have ailenne cannon removed. >> it's unlikely, the everyday for that jack smith hasn't asked for that yet. what jack smith realizes is what everyone else realizes is that it's okay to criticize judges, they get it wrong all the time, but getting it wrong in your opinion isn't the same thing on grounds for recusal, an overt bias for the defendant like donald trump maybe you not a shot. if you don't like the rulings it will be a long shot. >> thank you both. we have new details on the deadly mass shooting at a grocery store in arkansas, over the weekend, authorities announced the death toll rose to 4 people and 11 others were hurt in the shooting. >> reporter: we're learning new information today about the four

victims who died in the tragic mass shooting in arkansas on friday. it's a very small town of 4,000 people, 70 miles south of little rock, where everyone knows each other, i was there over the weekend and many people i spoke to say they frequented the grocery store where that mass shooting took place and they either knew someone who was in that grocery store or they knew someone who was shot, many of them even knew the suspect. of the 14 shot, 2 of them were law enforcement officers who were treated for nonlife-threatening injuries and then released from the dallas county medical center, one person shot was the suspect when gunfire was exchanged between law enforcement and the shooter. of the 11 civilians two were shot 4 of them tragically passed away, today we're learning new information about them, including 23-year-old callie weems who now arkansas state police are describing as a hero, they say that she used her

training as a nurse to try to render aid to other people who had been shot by the gunman, she leaves behind a 10-month-old baby daughter, sherry taylor's described as a loving mother and grandmother. roy sturgis was 50 years old. and is being remembered as a devoted father to his daughter hannah sturgis. and ellen shrum passed away saturday at the dallas county medical center after fighting for her life. i got a chance to speak with some of the victims' family members. let's take a listen. >> she was the most hardworking woman i have ever known in my life. she always put her family first. >> noah was a lover. big hearted.

>> always worried about other people. >> you could stab her in the back 17 times, and she'd still help you. >> reporter: authorities have identified 44-year-old travis eugene posey as the suspect, he now faces four charges of capital murder, law enforcement officials briefed about the mass shooting say there's no indication that there were any ties to hate crime or extremism, it appears as though this was a completely random, senseless attack as they describe it, but arkansas state police is still investigating the motive. russia is vowing retaliation and blaming the united states for a deadly attack in crimea, moscow says ukraine was behind the attack that killed four people and hurt more than 150 others using washington-supplied missiles. russia annexed crimea from ukraine ten years ago, long

before this current war. danielle joins me now, what more are we learning about this attack and has the united states responded. >> no official response from washington yet and what we do know comes directly from the kremlin, only from the clem lin, russia says that ukraine launched atacms missiles, programmed by the united states and guided by american satellites. they claim to have intercepted five missiles over crimea, loaded with cluster warheads, again launched by ukrainian forces and the deaths and injuries were caused by the debris falling on a beach, it's the summertime, life goes on despite a war, according to lavrov the russian foreign minister, he said that he claimed today no way these missiles could have been used by

the ukrainians without direct participation by the u.s. >> the what exactly happened over the weekend and who may be behind that attack? >> no one has claimed responsibility yet, according to russian lawmakers, some are saying are putting the blame on islamist sleeper cells. one quoted they're not able to defeated russia from the outside the enemy is looking to blow up our society from the inside. this happened in the dagestan region. predominantly muslim. 20 killed, 46 people injured in the cities. among them, a 66-year-old priest who had been serving the church for more than 40 years.

now to a chaotic scene in west los angeles over the weekend, violence broke out between a pro-palestinian protesters and supporters of israel outside a synagogue. video appears to show people yelling at each other and there reports of people throwing punches and using protest signs as weapons. police in riot gear were called in to break off the tense situation. david, we have seen a lot of protests over the last few months, have any arrests been made? >> reporter: yeah, this was serious, if only because of the amount of attention it's getting

from elected officials. mostly because this protest and altercations happened outside a synagogue in a heavily jewish part of west l.a. the reason there was a protest at that synagogue there was an event being held in the synagogue promoting real estate in israel. in the west bank. that's why protesters targeted this specific event. there was one arrest of a person at the protest who was carry wag the police described as a spike pole, sign or flag pole. the lapd is investigating two official reports of battery. this is certainly less than what we saw during the encampment on the ucla campus here in l.a. in terms of the amount of

south san jose. san jose fire tells us that three people live inside that home. one person did suffer burns that are not believed to be life threatening. fire started a little after 9:00 this morning on blossom avenue. school is across the street from this home. firefighters say the fire briefly threatened several adjacent homes, but teams managed to put it out on time. no word yet on a cause in the east bay. don't be alarmed if you see firefighters in the berkeley hills. they're actually holding the first day of wildfire training, and it may lead to some smoke in nearby areas. it's happening at three locations grizzly peak, tilden park, and the town of kensington. so firefighters say no need to call 911 if you do see smoke in those areas. it's all part of the drill. drills are also happening tomorrow, wednesday and friday from 830 in the morning until 230 in the afternoon, and it is another hot day in the bay area. meteorologist kari hall is warning us to watch out for dry lightning and wildfire conditions as we go throughout today, we may see a few more clouds and the risk of dry lightning that could be close to

the bay area. that's thunderstorms where the rain dries up before it hits the ground, and that will increase the fire danger and then as we go throughout the week, the sea breeze returns, brings in some better air quality and cooler temperatures. but today it's still hot in the valleys with highs in the low 90s. we'll see a high of 91 in livermore and upper 80s for parts of the north bay, while san francisco will be in the mid 60s for this afternoon, and tomorrow's basically a repeat of today. we may see some of those numbers coming down a couple of degrees, but we will be on a cooling trend from the middle to end of the week. so we'll take a look at our 7-day forecast coming up in about 30 minutes. all right. kari, thank you. governor newsom is set to deliver his state of the state address. tomorrow comes just a few days after he and state lawmakers reached a new budget deal. they released the final proposal over the weekend, and the details will be covered in the state of the state address. it includes funding cuts to affordable housing programs and the prison system, and that does it for this edition of the fast forward. we will be back in 30

during the hajj in saudi arabia. those making the journey face temperatures over 120 degrees fahrenheit. the saudi health minister says most of those who died were unauthorized pilgrims who walked long distances to perform hajj rituals. the state of california, a 4-year-old boy who wandered away from campground was found safely, the child was rescued after spending 22 hours alone in the wilderness. he was found friday morning in good health about a quarter mile from where he was last seen, his parents expressed their gratitude toward the search and rescue team and shared that he's happy, hungry and in great spirits. a monolith that was found near las vegas has been taken down. by authorities. the latest discovery in a series of columns that have popped up around the country since 2020. las vegas police say it's still unknown how the monolith got to the location or who might be

responsible. it was removed over the weekend because of public safety and environmental concerns. it's being stored in an undisclosed location. now to the race for the white house, we're just three days away from the first presidential debate, more than 1300 days since either president biden or former president donald trump have been on a debate stage, this will be the earliest general election debate in decades, thursday's event will be a chance to shake up what is a very tight race. a real clear politics average of national polls has trump leading by just .9%. let's bring in monica alba and vaughn hillyard. monica, let's start with you, president biden spent the weekend at camp david, what do we know about how he's preparing for thursday's debate. >> he has been in these intensive sessions for a couple of days now and that's the plan until thursday when he'll head to atlanta from camp david and

he's surrounded by a roster of close aides and advisers, people who have known him for decades and helped prepare him for past debates and the policy experts to help shape some of the topics and answers they expect will come up in this debate. they're discussing these larger questions which donald trump is going to show up to this debate. that's what they're trying to prepare for and we'll see what version we'll get on thursday. >> intense prep at camp david. vaughn, you cover the former president, he's been on the campaign trail, what does his debate prep look like, if anything, walk us through that. >> reporter: we're told it's exactly different than president

paris. his biggest rival, fellow teammate and silver medalist joe kovacs and for him shot put is a family affair. first off, congratulations. >> we're excited to go both together. >> reporter: in swimming katie ledecky is heading to her fourth olympics. in men's caeleb dresselle heading. reporting from eugene, oregon, tom llamas, nbc news. we're counting down to the opening ceremonies of the paris olympics next month and for many events we'll watch the competition from venues which have been around for years or centuries. a big part of how paris was able to cut its carbon footprints. chase cain recently traveled to

paris for a firsthand look. >> when you look at the last two summer olympics, tokyo and rio, their carbon footprint was because of what they built. paris, construction was the top target, they didn't just think what they wanted to build they also wanted to think about how they built it. building any new stadium or arena comes at a cost to our planet. >> understanding the long list of things, you know, like the bill of the materials of the games was key for us to understand it and then challenge it. >> reporter: ahead of paris 2024 sustainability explained how they combed through everything. most importantly, what they chose not to build. >> do you really need to build a

new arena. >> reporter: inside one of two new venues built for the olympics. it's a minimal arena, not a lot of extra stuff in here and one of the things that fans will notice first, these seats are made entirely of recycled plastic. the company who made the seats worked with 50 recycles to gather tonsf plastic. instead of that plastic trash became 11,000 seats. the other new construction was the olympic village, permanent housing for thousands after the game, built with less concrete, more wood to limit its carbon footprint, it faced pushback from athletes for its exclusion of traditional air-conditioning in front of carbon free geo thermal cooling. >> the risk of innovating, showing that this should work.

>> reporter: another wave of backlash followed construction of an observation tower of a reef in tahiti for olympic surfing. out all of the existing venues this one has the most history. this stadium was here a century ago for the 1924 summer olympics, it hosted the opening ceremonies. but this summer it's going to host field hockey. cities across france hope to show what's best for our planet is what you already have. l.a. 2028 decided to embrace no new venue. ady have,ldin >> reporter: team usa is anni bring tir own acs. >> we mentioned this in the story, the olympic village is going to be plugged into geo thermal cooling. it will keep temperatures inside if it's hot outside 78, 80 side.
